Monia GALLAY, Certified Kinesiologist and Bach Flower Practitioner, has created a micro‑enterprise registered under SIRET number 10249644500010, with its registered office located in Haute‑Savoie.

Monia GALLAY E.I has taken out a group insurance policy with AXA (contract no. 11485633304) covering her professional and operational civil liability.

Careful reading and acceptance of these General Terms and Conditions (GTC) is required before any appointment is made. They define the applicable conditions.

Description of services: Kinesiology and Bach Flower Counselling.

The website www.moniagallay.com allows users to access a detailed description of the services offered by Monia GALLAY, including pricing. Appointments may be made through the website, via the contact form, by email at moniagallaykinesiologie@outlook.com, online via TERAPIZ, or directly by phone.

ARTICLE 1 – Legal Notice

The services offered within the scope of Kinesiology and Bach Flower Counselling fall exclusively within the fields of well‑being, personal development and non‑medical support.

They have no medical, therapeutic or diagnostic purpose and do not replace medical, psychological or paramedical care.

They are not comparable to acts reserved for regulated health professions under the French Public Health Code, nor to those defined by Decree n°96‑879 of 8 October 1996.

The client acknowledges that the sessions do not replace medical treatment, medical advice or psychological support, and agrees to consult a healthcare professional for any matter relating to the medical field.

 

ARTICLE 2 – Scope of Application

These General Terms and Conditions apply, without restriction or reservation, to all services offered by Monia GALLAY.

Appointments may be made for the following services: – Kinesiology sessions (at the practice or at home - max 15km) – Bach Flower Counselling (at the practice, at home or remotely via video call)

 

ARTICLE 3 – Prices, Payment Terms and Invoicing

Service prices are listed on the website in euros, VAT included.

These prices correspond to those in effect on the date the appointment is made.

Payment is made on the day the service takes place, using one of the following methods: Cash, French bank cheque payable to Monia GALLAY, credit card, bank transfer, Wero.

An invoice will be given or emailed to the client after the session.

ARTICLE 4 – Appointment Booking

Clients may book an appointment for a kinesiology session or a Bach Flower Counselling session via TERAPIZ, by email or by phone. To book a service, the client must follow the steps below:

– Selection of the service and acceptance of the price

– Selection of the date and time, in agreement with Monia GALLAY depending on availability

– Acceptance of the GTC and acknowledgement of the legal notice

– Communication of contact details (name, surname, phone number, email address)

A confirmation message will then be sent by text message or email before the appointment.

ARTICLE 5 – Parental Consent for Minors

Sessions for minors can only be carried out with written and signed parental consent. Without this document, the session cannot take place, in accordance with the conditions of the professional liability insurance.

ARTICLE 6 – Service Delivery

The services booked by the client will be provided on the date and at the time chosen during the booking process, and according to the detailed description available on the website.

 

ARTICLE 7 – Rescheduling, Cancellation and Modification of an Appointment

Clients may cancel or reschedule an appointment up to 24 hours before the scheduled time, by phone, SMS or email.

After this deadline, any cancelled, rescheduled or missed session is fully due.

In case of client delay, the session will end at the initially scheduled time so as not to affect subsequent appointments. The price remains unchanged.

ARTICLE 8 – Protection of Personal Data

In accordance with Law n° 78‑17 of 6 January 1978, it is recalled that the personal data requested are necessary for appointment booking and are used exclusively for client management by Monia GALLAY E.I.

This data will never be shared with third parties.

Clients have the right to access, modify or oppose the processing of their data.

Personal data collected during online appointment booking is necessary for: managing appointments, sending information related to the services offered, before or after the session, in compliance with applicable legislation.

ARTICLE 9 – Intellectual Property

All documents, texts and information on the website are the exclusive property of Monia GALLAY or are royalty‑free. Any full or partial reproduction of content without prior authorisation is prohibited under Article L.122‑4 of the French Intellectual Property Code.

ARTICLE 11 – Dispute Resolution

These General Terms and Conditions are governed by French law, as are all disputes relating to their validity, interpretation, execution or termination. In the event of a dispute, jurisdiction is assigned to the court of the registered office of Monia GALLAY. The reference language for any legal proceedings is French.

ARTICLE 12 – Consumer Mediation

If you are unable to resolve your dispute after sending us a written complaint (letter or email), dated and describing the circumstances of the disagreement and the remedy you are seeking, you may refer the matter to the French consumer mediator designated below—provided you have received a written negative response from us or no response within two months.In accordance with Articles L.616‑1 and R.616‑1 of the French Consumer Code, a consumer mediation system has been implemented.
